1.1 These Terms and Conditions ("Terms") govern your use of MathAppy ("the App"), a mobile application available on the Apple iOS platform, developed by Square Tomato ("we", "us", "our").

1.2 By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Acceptance of Terms

2.1 These Terms constitute a legally binding agreement between you and Square Tomato, governed by the laws of England and Wales.

2.2 We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting online accessible through the App or via an app update.

3. App Store and Apple Policies

3.1 You acknowledge that these Terms are between you and Square Tomato, not Apple Inc.

3.2 Your use of the App is also subject to Apple's App Store Terms of Service and Usage Rules.

3.3 Apple is not responsible for the App's content, maintenance, support, or any other services related to the App.

4. User Eligibility

4.1 By using the App, you confirm that:

- You are at least 13 years of age
- You have the legal capacity to enter into these Terms
- You reside in a jurisdiction where use of the App is legal

4.2 We reserve the right to verify age and refuse service to anyone we believe does not meet these requirements.

5. User Account and Registration

5.1 To access certain features, you may be required to create an account.

5.2 You agree to:

- Provide accurate, current, and complete information
- Maintain the confidentiality of your account credentials
- Accept responsibility for all activities under your account

5.3 You must notify us immediately of any unauthorized use of your account.

6. App Usage Rights

7. Intellectual Property Rights

- Source code
- Design
- Graphics
- User interface
- Functionality

Remain the exclusive property of Square Tomato.

7.2 Apple and its licensors retain all rights to the iOS platform and related technologies.

8. User Content and Permissions

8.1 If the App allows user-generated content, you grant us a worldwide, royalty-free license to use, reproduce, and distribute such content.

8.2 You confirm that user-generated content:

- Does not infringe third-party rights
- Is not offensive, defamatory, or illegal
- Complies with our community guidelines

9. Privacy and Data Protection

9.1 Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

9.2 We comply with the UK Data Protection Act 2018 and UK GDPR.

9.3 The App requires access to storage on each device to be installed and operate.

10. In-App Purchases

10.1 There is no facility to make In-App purchases in MathAppy One

11. Limitation of Liability

11.1 To the maximum extent permitted by English law:

- The App is provided "as is" without warranties
- We exclude liability for indirect, incidental, or consequential damages
- Our total liability is limited to the amount paid for the App

12. Termination

12.1 We may terminate or suspend your access to the App:

- For breach of these Terms
- At our discretion
- Without prior notice

12.2 Upon termination, your right to use the App immediately ceases.

13. Dispute Resolution

13.1 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13.2 Before legal proceedings, parties agree to attempt mediation.

14. Miscellaneous

14.1 If any provision of these Terms is found invalid, the remaining provisions continue in full force.

14.2 These Terms constitute the entire agreement between you and Square Tomato.
